General Terms and Conditions for Ski / Snowboard Equipment Rental from the Ski Rentals Managed by Ulen AD, Bansko

1. These General Terms and Conditions regulate the procedure and manner of ski / snowboard equipment rental from the ski rentals managed by Ulen AD and the rules for using the rented equipment. They are valid and apply to the clients of all ski rentals managed by Ulen AD, namely: the ski rentals in the Base Station, Banderishka Polyana Ski Rental and Elite Ski Rental located in hotel Kempinski Grand Arena Bansko.

2. These General Terms and Conditions are placed in the ski rentals and are published on the website banskoski.com. They are applicable in their entirety and cannot be modified by customers. They have been approved by the Management of Ulen AD, and if necessary and at its discretion the Company may amend and supplement them, as these amendments will be considered effective from the date of their public announcement on the site Banskoski.com, and / or their placement on the designated places in the Ski Area. The clients of Ulen Ski Rentals are obliged to get acquainted with the current GTC before purchasing the offered services. Everyone who has objections or does not accept these General Terms and Conditions or part of them, exercising his right to free discretion, may decide not to use the services offered by Ulen Ski Rentals.

3. The rented equipment in the ski rentals of Ulen AD is maintained and adjusted by qualified employees of the Company. Periodically, testing for suitability and adjustment of the ski bindings is performed through a Speedtronic machine, certified by the Austrian company Wintersteiger. Therefore, we aim at providing quality and safe equipment for all our customers.

4. The prices of the services provided in Ulen AD ski rentals, by types of equipment and age categories are announced on boards in each of the rentals and on the website banskoski.com. Please note that children's ski equipment is up to: No.35 boots and ski length up to 130 cm.

5. In order to rent ski / snowboard equipment, the client should register in the Easyrent system by filling in a registration form at terminals located in the ski rentals. To register, the client must provide the following information: names, date of birth, administrative address, city code, city, country, place of accommodation and e-mail/ by client’s request/. Completion of all these data is necessary as a step to sign a contract for "ski / snowboard equipment rental" and to fulfill the obligations arising from it. With the explicit consent of the client, the e-mail can be used to provide useful information or special offers.

6. In addition to the data specified in the previous point, the client must provide the following information: gender, height, weight, shoe size, sole length, skiing / snowboarding skills. Based on these data, the customer is provided with equipment with appropriate settings that meet the safety requirements and in accordance with the information provided by him in the registration form.

7. By registering and signing, the client confirms the completeness and correctness of the data provided by him, and has no right to claim compensation for damages incurred as a result of incorrect information provided by him.

8. After registration in the Easyrent system, the customer is equipped by employees of the ski rental  with an appropriate equipment. То draw the contract for the rented equipment, the client should provide an identity document, which is read by an electronic reader (MRZ) in order to generate the necessary data for drawing up the rental agreement. The client receives equipment from Ulen's ski rentals after payment for the respective service on the spot at the checkouts in the ski rental and after signing the contract. By signing the contract, the client declares that he is familiar with these General Terms and Conditions and undertakes to comply with them, confirms the accuracy of the data filled in by him and declares his explicit consent for his personal data to be processed by Ulen AD in accordance with Privacy Policy. For the rented equipment he receives a copy of the rental agreement signed by the client, which should be kept until the end of the period for use of the rented equipment.

9. The client shall be responsible for the rented equipment and undertakes to protect it from encroachments on it by third parties, and shall use it "with the care of a good owner" in accordance with its purpose. The client undertakes to immediately notify the employees of the ski rentals of any damage caused to the rented equipment, as well as any encroachments on it by third parties. The customer has no right to sublet the rented equipment to third parties.

10. The client has no right to make any changes in the setting of the rented equipment, made by the staff of the ski rental. If there is a need for additional adjustment, the client is obliged to ask the staff of the ski rental to do it, and all changes should be reflected in the rental agreement.

11. During renting of the equipment, the client has the right to store the rented skis or snowboards in the ski rental from where they are rented, or in another appropriate and safe place, including the place of accommodation where the client is staying.

12.Until 5.30 p.m. of the last day of the term of renting of the equipment the Client is obliged to return it in the condition and state, in which it is rented. In case a person keeps the rented equipment for longer than the paid period, he is obliged to pay the difference between the amount paid and the amount actually due for the longer period.

13. In case of established damage, including breakage of the equipment or its component, as a result of its use during the term of the rental agreement, the Client is responsible for the costs for repair or replacement of the missing components. In case of permanent damage of the rented equipment, which make it absolutely unusable, the Client is obliged to pay its full value at prices approved by the management of Ulen AD. The full value of the rented equipment is due by the client in case of theft or loss of the same.

14. Ulen AD shall not be responsible for injuries or accidents caused or occurred: when using the equipment for other purposes; due to improper speed; in case of non-compliance of the specific snow and meteorological conditions with one's own skills / abilities for skiing / snowboarding; due to filled in incorrect data in the registration form; in case of unauthorized change by the client or a third party of the settings of the ski bindings after receipt of the equipment from Ulen’s ski rentals and others.

15. Ulen AD shall not be responsible and shall not owe any reimbursement of the value of the rented equipment, when its use has started and any of the following events occur: interruption of the power supply; accidents, unfavorable climatic conditions - strong wind, heavy snowfall, lack of snow, very low or very high temperatures, fog, heavy rain and others; partial closure for reasons of safety of slopes and cableways in the ski area, or for conducting sports competitions, training and / or other events and / or other assumptions provided for in the applicable law; in case of illness, trauma or accident of the client, which occurred during the use of the equipment; termination by the client of the use of the equipment before the expiration of the period, for which it is rented, regardless of the reason for this; in case of force majeure and other similar circumstances, which cannot be foreseen when renting the equipment.

16. At ULEN AD we understand the responsibility, which we bear for your personal data and strive to observe high standards for protection of personal data and personal privacy. We collect, store and process your personal data only to the extent necessary for the conduct of our business, with clearly defined objectives and compliance with the requirements of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data (in short the Regulation) and the Personal Data Protection Act (PDPA). We strive to ensure lawful, conscientious and transparent processing of personal data for specific legitimate purposes, explicitly stated in the privacy policy published on the company's website / www.banskoski.com /, observing the principles of "minimizing data" , "accuracy", "storage limitation", "integrity and confidentiality" and "accountability".

17. The legislation of the Republic of Bulgaria is applicable for all unsettled issues in the lease contract. All disputes arising in connection with the implementation or interpretation of the rental  agreement will be resolved by the parties in an amicable way, and in case of impossibility for amicable dispute resolution – shall be resolved by the competent Bulgarian court.



General Terms and Conditions for Using the Service "Ski School" at Ulen Ski School, Managed by ULEN AD, Bansko

1. These General Terms and Conditions regulate the order and manner of using the following services: individual ski / snowboard training; group ski / snowboard training; ski / snowboard training offered by Elite Ski School, cross-country skiing, Junior ski school and the service "First run", provided by Ulen Ski School, managed by Ulen AD and the rules for using the individual services. They are valid and apply to all clients of Ulen Ski School, regardless of the place of payment for the service: including clients who paid for the service in the office of Ulen Ski School, located at the Gondola lift base station, clients who paid the service at Ulen AD ticket desk, located in hotel Kempinski Grand Arena Bansko, and clients who have paid for the service in Banderishka Polyana Ski Rental.

Completion of all these data is necessary as a step to sign a contract for the use of the services: individual ski / snowboard training; group ski / snowboard training; ski / snowboard training by Elite Ski School, cross-country skiing, Junior Ski school and the service "First run" and to fulfill the obligations arising from it. With the explicit consent of the client, the e-mail can be used to provide useful information or special offers.

4. When purchasing the services: individual ski / snowboard training; group ski / snowboard training; ski / snowboard training by Elite Ski School, cross-country skiing in addition to the data specified in the previous point, the client must provide the following information: skills for skiing / snowboarding. Based on these data and by performing a ski test, the actual level of skiing / snowboarding is determined by the client, for his proper grouping or, respectively, appointment of as a proper ski instructor according to his needs. The ski test is performed by professional ski instructors with many years of experience in skiing / snowboarding training on a suitable terrain, consistent with the information provided by the client, his age and the level of physical and functional training.

5. By registering and signing, the client confirms the completeness and correctness of the data provided by him, and has no right to claim compensation for damages incurred as a result of incorrect information provided by him.

6. То draw the contract for using the service, the client should provide an identity document, which is read through an electronic reader (MRZ) in order  to generate the necessary data for drawing up the contract for using the service / names, date of birth, address /. By signing the contract, the client declares that he is familiar with these General Terms and Conditions and undertakes to comply with them, confirms the accuracy of the data filled in by him and declares his explicit consent for his personal data to be processed by Ulen AD in accordance with the Privacy Policy. For the service used by the client, he receives a copy of the service contract signed by him, which should be kept until the end of the period for its use.

6. The ski / snowboard training provided by Ulen Ski School is carried out according to an approved methodology by the Bulgarian Ski Federation. The technical elements in ski / snowboard training are divided into three levels: class A / including beginner skiers and snowboarders /, class B / including advanced skiers and snowboarders / and class C / including experts in the field/, as the training of a client of a given level is performed by an instructor holding a qualification for the relevant class.

7. Ulen Ski School guarantees and is responsible that the ski / snowboard training service is provided by ski instructors who have both the necessary professional qualification and legal capacity, according to the provisions of the current Bulgarian legislation, and the necessary practical training in view of the terrains in Ski Center Bansko.

8. The prices of the services provided in Ulen Ski School, by types and age categories are announced on boards in each of the above premises and are announced on the website banskoski.com. Please note that the discount for children is used by children up to 12 years /incl./ against presentation of a document certifying the age of the child.

9. The group ski / snowboard training service is a training of groups of clients, including 3 to 10 people with similar skiing skills. Elite Ski / Snowboard School service provides the use of a quick access corridor to all cable cars on the territory of the Ski Center.

10. The "First run" service can be used during the winter season, in appropriate weather conditions and sufficient snow cover. The price of the service includes: breakfast on Banderishka Polyana in  Bachvite restaurant and an accompanying certified ski instructor from Ulen Ski Sschool. The service for children from 7 years to 12 years /incl./ can be purchased upon presentation of a document certifying the age of the child. The price of the service does not include a lift pass. The group of skiers may be composed of minimum 4, and maximum of 8 individuals. Registration should be made two days in advance, by submitting an application at Ulen Ski School located at the base station of the Gondola lift and at Elite Ski School at hotel Kempinski Grand Arena Bansko.

11. The "Junior ski school" service can be used by children aged from 4 to 7 years inclusive, including: a gondola ticket, ski training / depending on the age of the child /, ski equipment / skis, poles, shoes, helmet, reflective vest /, classes with an instructor, various games and lunch.

12. The clients are responsible for the condition and efficiency of their personal equipment and use the services offered by Ulen Ski School at their own risk. Ulen AD shall not be responsible for injuries or accidents caused or occurred during the use of the services offered by the ski school due to the guilty conduct of the client; non-compliance with the instructions of the ski instructors and the staff in the ski center; non-compliance with the specific snow and weather conditions with their  own skills / abilities for skiing / snowboarding; filled in incorrect data in the registration form; improper speed; unauthorized change by the client or a third party of the adjustments of the ski equipment, or non-use of quality / necessary equipment, other reasons beyond the control of Ulen Ski School.

13. When using the services offered by Ulen Ski School, the client is obliged to comply with the instructions and recommendations of the ski instructors, to comply with both the provisions of these GTC and the general rules for using the ski area, including the rules for safe behavior in Ski Center Bansko and to comply with the markings of the ski slopes. The ski instructor has the right to terminate the client's participation in the training course, in cases when: qualified staff considers that the equipment used by the client is inappropriate or unsatisfactory and / or in case the client does not comply with the instructions and recommendations of the ski the instructor and / or his behavior endangers the safety of all clients in the group and of the tourists in general in the Ski Center.

14. The client is obliged to keep the appointment for the training course, with the necessary equipment and facilities. In case of delay, non-appearance of a client or lack of necessary / appropriate equipment, according to the preliminary instructions of the instructors, as well as non-use of the service for reasons, for which the client is responsible, the ski school shall not owe a refund or payment of any compensation.

15. In case of failure to provide the service at the time agreed with the client through the fault of the ski school, no monetary compensation or refund is due, but a compensatory service will be  provided under an additional agreement with the client.

16. Ulen AD shall not be responsible and shall not owe any reimbursement of the value of the paid service, when its use has started and any of the following events arise: interruption of the power supply; accidents, bad weather conditions - strong wind, heavy snowfall, lack of snow, very low or very high temperatures, fog, heavy rain and others; partial closure for reasons of safety of slopes and cableways in the ski area, or of conducting sports competitions, training and / or other events and / or other hypotheses provided for in the applicable law; in case of illness, trauma or accident of the client, which occurred during the service use; if the client terminates the service use before the expiration of the period for which it is paid, regardless of the reason for this; in case of force majeure and other similar circumstances, which cannot be foreseen when purchasing the service.
